BREAKING NEWS: Texas Court Issues Order Enjoining DOL's Final Salary Threshold Rule
November 22, 2016
By J. Kent Pearson, Jr.
Earlier today, a Texas federal court judge issued a nationwide preliminary injunction enjoining the U.S. Department of Labor’s final salary threshold rule from going into effect on December 1, 2016, as scheduled. The rule would have raised the salary threshold for “white collar” exemptions from $455/week to $913/week ($47,476 per year), and provided for automatic updates of the salary threshold every three years based on wage growth. We plan to provide additional insights regarding the implications of the injunction. In the meantime, we wanted to alert employers to this unexpected development.
